Keeping up the pressure: Some useful tenancy renewal tips for landlords.


In these times of increasing uncertainty it is important for a landlord to know exactly where it stands, especially when it comes to tenancy renewals. In contrast, a tenant is more likely to be willing to let tenancy renewal negotiations drag on for as long as possible in the hope of achieving a lower rent.

We set out below some tips for landlords to keep the pressure on tenants to renew:

  • Serve the section 25 notice as early as possible
  • After serving the section 25 notice, issue proceedings for a new tenancy
  • Once Court proceedings have been commenced, make a request to the Court for a case management conference and issue the tenant with a draft lease. Further try and agree directions for how the case will progress. It would be wise to set a timetable so that you will have your trial date as soon as possible
  • You may want to consider getting an expert report sooner rather than later
  • Try and get the tenant to tell you those elements of the lease that are not agreed or acceptable to it
  • In order to speed up the process you may wish to consider adapting the existing lease rather than using your new standard lease
  • Thought should also be given to applying for an interim rent from the start of proceedings and you should make sure that it is dealt with during the negotiations before the new lease is completed.
